Dispute Resolution

Expedited Arbitration

Fast-track arbitration delivering efficient resolution and binding awards within compressed timeframes for construction and commercial disputes.

Streamlined Resolution

What is Expedited Arbitration?

Expedited arbitration is a streamlined arbitration procedure designed for disputes of moderate value or complexity where parties require efficient resolution. It is particularly suitable for disputes where the amount in controversy does not exceed USD 1,000,000, or where the parties have agreed to expedited procedures, or where exceptional circumstances of urgency exist that make standard arbitration inappropriate.

Proceedings are conducted by a sole arbitrator selected for expertise and experience in the construction industry. The procedural timetable is compressed to eliminate unnecessary delay whilst maintaining procedural fairness and the parties' rights to present their cases fully. The arbitrator will issue a final award within six months from the date of appointment, with provision for extension to nine months in exceptional circumstances.

Efficient Process

Speed Without Compromise

Expedited arbitration procedures maintain full due process safeguards whilst eliminating unnecessary procedural delay. The process is designed to avoid the inefficiencies that can arise in standard arbitration without sacrificing substantive fairness or the parties' ability to present their cases comprehensively.

The framework preserves the parties' rights to present evidence, call witnesses, and advance their arguments whilst enabling proportionate and cost-effective resolution tailored to the scale and complexity of the dispute.

Key Advantages

Expedited Arbitration Framework

Expedited arbitration combines the formality and enforceability of standard arbitration with accelerated procedures designed to deliver timely resolution. The process is structured to address disputes that would be disproportionately delayed or costly under full arbitration procedures.

01

Sole Arbitrator

Proceedings are conducted by a sole arbitrator selected for substantial construction industry expertise. This ensures both operational efficiency and technical understanding of the issues arising in construction and engineering disputes.

02

Compressed Timetable

Defined procedural milestones and timeframes provide certainty of process and enable final award to be issued within six months. The compressed timetable eliminates delay inherent in standard procedures whilst maintaining sufficient time for proper consideration of the parties' cases.

03

Reduced Administrative Fees

Expedited arbitration operates on a cost-efficient fee structure that recognises proportionality. Where disputes are of moderate value or complexity, proportionate procedures should be reflected in proportionate fees, reducing overall cost burden on the parties.

04

Binding Awards

Awards issued in expedited arbitration are final and binding, enforceable internationally under the New York Convention. This provides the same legal certainty and closure as standard arbitration, enabling parties to move forward with certainty regarding the outcome.

Tailored Approach

When is Expedited Arbitration Appropriate?

Expedited arbitration is most suited to disputes where full arbitration would be disproportionate to the value or complexity of the issues in contention. It enables parties to obtain formal, binding determination of their disputes without incurring the time and cost investment required for comprehensive arbitration procedures.

Proportionate Resolution

Expedited arbitration suits disputes where the interests of justice are satisfied by streamlined procedures proportionate to the amounts or issues in contention. This approach reduces the cost and time burden on parties whilst delivering binding determination that would otherwise be unavailable through informal dispute resolution.

Construction Expertise

Arbitrators in expedited proceedings are drawn from specialist panels with substantial experience in construction, engineering, and infrastructure disputes. This ensures the arbitrator understands the technical, contractual, and commercial context of construction disputes without the delay and cost of larger arbitration panels.

Institutional Framework

Expedited arbitration is administered under established institutional rules and procedures, providing formal appointment mechanisms, procedural safeguards, and administrative support. This institutional framework ensures procedural consistency and integrity whilst maintaining the efficiency benefits of expedited procedures.
