The Secure Document Portal (the "Lockbox") is a facility provided for the confidential submission of documents by parties to active dispute resolution matters administered by or involving Expert Services International. Use of the Lockbox is subject to the following conditions:
All documents submitted through the Lockbox are treated as strictly confidential and will be used solely in connection with the matter to which they relate. Expert Services International will not disclose documents submitted through the Lockbox to any third party without the express consent of the submitting party or as required by law or by the rules of any applicable dispute resolution process. Access to the Lockbox is restricted to authorised users who have been provided with a valid matter reference and access code by Expert Services International.
Whilst Expert Services International employs reasonable technical measures to protect documents submitted through the Lockbox, including encryption in transit and secure storage, Expert Services International does not warrant that the Lockbox is immune from unauthorised access, interception or system failure. To the maximum extent permitted by law, Expert Services International accepts no liability for any loss, damage, corruption or unauthorised disclosure of documents submitted through the Lockbox, howsoever arising. Users submit documents through the Lockbox at their own risk and are responsible for maintaining their own copies of all documents submitted.
The Nominations facility enables prospective clients and their legal representatives to submit enquiries to engage the services of Expert Services International. All information submitted through the Nominations facility is treated as confidential and will be used solely for the purpose of assessing the nomination, conducting a conflicts check and, where appropriate, corresponding with the nominating party in relation to the proposed engagement. Submission of a nomination does not create a professional-client relationship or an obligation on the part of Expert Services International to accept the engagement.
The Website may contain links to third-party websites that are not operated or controlled by Expert Services International. Expert Services International has no control over, and accepts no responsibility for, the content, privacy policies or practices of any third-party website. The inclusion of any link does not imply endorsement, approval or recommendation by Expert Services International of the linked website or its content.
Expert Services International is committed to protecting the privacy of users of the Website. Personal information collected through the Website, including through the contact form, Nominations facility and Lockbox, is collected and handled in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Personal information will only be used for the purpose for which it was collected and will not be disclosed to third parties without consent, except as required by law.
Expert Services International reserves the right to amend these Terms of Use at any time without prior notice. Any amendments will be effective immediately upon publication on the Website. Continued use of the Website following the publication of amended terms constitutes acceptance of those amended terms. Users are encouraged to review these Terms of Use periodically.
These Terms of Use are governed by and construed in accordance with the laws of New South Wales, Australia. Any dispute arising out of or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of New South Wales.
